The Urgency of Implementation of Deferred Prosecution Agreements for Corporate Crimes in Indonesia: A Comparative Law Study

Criminal law is one of the main pillars in the enforcement of justice and public order. As a normative instrument, criminal law not only functions to punish perpetrators of criminal acts but also to prevent crimes and protect the rights of the community Along with the times, various social and economic dynamics have created new challenges for the Indonesian criminal law system which is entering a new era with the enactment of the 2023 Criminal Code, a paradigm revolution that shifts the orientation of the justice system from being retributive to The new Criminal Procedure Code that regulates more clearly including related to corporate crimes and provides a mechanism that can be used in resolving cases, namely the Deferred Prosecution Agreement (DPA), this study aims to look at the Deferred Prosecution Agreement in Corporate Criminal Liability: A Comparative Study and Urgency of Application in Indonesia, this research is carried out with a normative juridical type using the approach laws, cases, and comparisons with the United Kingdom, the results of the study show that normatively the DPA has been regulated in the provisions of the New Criminal Code and the role of each law enforcement officer in strengthening each other's implementation of the DPA, corporate crimes in Indonesia, especially corruption crimes, always cause losses to the state to strengthen the position of the need for the implementation of the DPA.
